What Is the Cash Discount Program and Is It Legal in Nevada?

If you own a business in Las Vegas, you have probably heard about the cash discount program by now. And you probably have the same two questions every owner asks me before making a move.

What is it? And is it legal?

Short answer: yes, it is legal in Nevada when it is set up the right way. Here is how it works, what the rules are, and how to tell if it makes sense for your business.

What is the cash discount program?

A cash discount program is a way of pricing that moves the cost of card processing off your books. Your posted prices are your card prices. Customers who pay with cash get a discount off that posted price.

So the customer paying by card covers the cost of using the card, and the customer paying cash pays less. You keep what you earned on the sale instead of handing a cut to the processor every month.

Most small businesses lose somewhere around 2% to 4% of their card sales to processing. If you want to see your own number, plug your monthly card sales into our free credit card fee calculator. No signup, no email.

Is the cash discount program legal in Nevada?

Yes. Here is why.

Federal law has protected a merchant's right to offer a discount for cash since the early 1980s, and the Durbin Amendment in 2010 confirmed it. Card brands like Visa and Mastercard allow cash discounts too, as long as the program is disclosed clearly.

Nevada does not have a state law banning cash discounts or surcharges. What matters is how the program is run:

  • Signs at the entrance and at the register that tell customers about the cash price.
  • Receipts that show the pricing clearly.
  • A terminal set up to apply the discount correctly every time.

Get those right and you are in good shape. Every program I set up for a Las Vegas business is built to meet card brand rules from the start, signage included.

Cash discount vs. surcharging: what is the difference?

People mix these up all the time, and they are not the same thing.

Surcharging adds a fee on top of your price when someone pays with a credit card. Visa caps surcharges at 3%, merchants have to notify their processor before they start, and surcharges cannot be applied to debit cards. A few states restrict them.

Cash discounting builds the card cost into your posted price and gives cash customers a lower price. Fewer moving parts and fewer rules to trip over.

There is also dual pricing, where you show both a cash price and a card price on your menu, shelf tags, or invoices. Customers see both numbers before they pay. If you want the full breakdown, read our surcharge compliance guide for Las Vegas businesses.

Which Las Vegas businesses get the most out of it?

It works for almost any business that takes cards, but it hits hardest for businesses with steady card volume and thin margins:

  • Auto repair shops, where one ticket can run into the thousands.
  • Salons, spas, and nail studios, where most customers pay by card.
  • Retail shops and boutiques with daily card sales.
  • Contractors, landscapers, and service businesses that invoice after the job.
  • Restaurants and food businesses that run a lot of card transactions.

How much could your business keep?

Here is simple math. A business running $15,000 a month in card sales at 2% to 4% is paying somewhere between $300 and $600 a month in processing. That is $3,600 to $7,200 a year.

Your number depends on your volume and your current setup. The fastest way to find it is the fee calculator. It takes about ten seconds.

I keep it simple. You send me a recent processing statement, I go through it with you, and I show you what you are paying today and what changes with a cash discount program. If it makes sense, we set it up. If it does not, I will tell you.

Quick answers

Is a cash discount program legal in Nevada? Yes. Nevada has no law against it, and federal law protects discounts for cash. It needs clear signage and disclosure.

Is cash discounting the same as surcharging? No. A surcharge adds a fee at checkout for credit cards. A cash discount lowers the price for cash.

Will customers be upset? Most do not notice or care when the signs are clear. Gas stations have priced this way for decades.
